More months elapsed, communications between myself and the ombudsman were scant, however I was building a picture that despite their claims to have to power to force the health service to cooperate, they did not have the level of control or powers they had claimed.

 

I was constantly reminded that my complaint was unique, that the ombudsman had never dealt with a complaint like mine and that everything they did was a first for them. They had never handled a complaint against the DOH, a government department, only having dealt with medical complaints against the NHS.

 

They did however state that they were prepared to take the DOH legal department to court to force their cooperation but warned that this would be in the high court, could take years, and could be subject to appeal.

 

At this point, CICA finally determined that I was a victim of sexual assault, this decision was based upon the police having recorded four crimes in my name.

 

In the absence of any prospect of compensation from the DOH or Savile’s estate, I received a small payment.

 

I notified the ombudsman of this outcome as further proof that I was a victim of Savile, should they need more.
